Pesticide Container Recycling
In a January 25, 2008 pesticide program update, EPA announced that the Agency intends to propose regulations that will require registrants of agricultural and professional specialty pesticide products to recycle plastic pesticide containers. EPA intends to follow an aggressive schedule in completing this rulemaking, and on March 28, 2008 the Agency published a notice in the Federal Register (73 FR 16614) informing the public of the Agency’s transmittal of a draft proposed rule to the USDA for comment. The USDA has 30 days to comment in writing, and if such comments are not forwarded to EPA, then the Agency may publish the proposed regulations any time after the 30-day period. EPA’s decision to complete this rulemaking on an expedited basis stands in marked contrast to the Agency’s prior statements indicating a slower rulemaking process, beginning with an Advance Notice of Proposed Rulemaking (ANPRM). EPA expects to provide a 60-day comment period for the proposed rule.
